The doctrine of the ECHR on same-sex couples: a view from the spanish system of private international law
Resumen
La jurisprudencia reciente del TEDH en materia de uniones de parejas del mismo sexo consolida ante todo la tendencia de los ordenamientos nacionales y de la opinión pública en favor de su reconocimiento y protección. La importancia de las últimas sentencias es que la doctrina se ha desvinculado de los datos procedentes el concreto sistema nacional afectado, imponiendo obligaciones positivas al legislador con independencia de lo que hayan dicho sus tribunales, sus normas internas o de la opinión de la mayoría de la población. Una consecuencia importante en clave nacional es la constatación del déficit normativo español, donde no existe un tratamiento conflictual completo de la pareja registrada.
