Administration and Disposal of Assets Granted Gratuitously in Favor of Persons with Disabilities: An Integrative Interpretation and Some Practical Considerations
Abstract
This essay examines the regime governing the administration and disposal of assets gratuitously allocated to persons with disabilities under Article 252 of the Civil Code. It argues that this mechanism constitutes a support measure and must therefore be interpreted in accordance with the principles that regulate such measures, taking into account the individual circumstances of the person with disabilities so as not to undermine the purpose of the reform introduced by Act 8/2021. The analysis also addresses the key elements shaping this legal arrangement: the assets concerned, the intensity of the support, the powers granted, and the bodies responsible for administration and oversight. Finally, the article explores how this regime interacts with other existing support measures.
