Notarial practice in relation to disabled persons in vulnerable situations.
Abstract
The variety of situations of vulnerability that a notary may encounter when dealing with a person with disabilities gives rise to numerous practical challenges. While those relating to legal vulnerability – in other words, medically and legally recognised vulnerability – are now generally under control, factual vulnerability can seriously compromise the legal certainty of the act. However, the measures implemented to dispel doubts about the capacity to give valid consent are not always consistent with domestic and international requirements for the protection of the rights and freedoms of persons with disabilities. This situation therefore calls for the development of new protective measures, in particular by enabling the effective anticipation of the legal handling of vulnerable situations.
