Essential characteristics of ownership and its possible regulatory redefinition
The impact of the Law 12/2023 of 24 May on the right to housing on the classic property regime
Abstract
This article analyses how Law 12/2023 of 24 May on the right to housing, has incorporated specific duties and limits to the classic regime of the right to property without altering its essential features: unity, perpetuity of ownership, exclusivity and abstraction of powers. After a brief historical overview that goes back to the nineteenth-century codification of article 348 of the Civil Code and a contrast with the French, German and Italian experiences, it is shown that the new regulations do not abolish the ‘title of ownership’ but specify its exercise in the residential sphere. Thus, the programmes of temporary transfer and mobilisation of empty dwellings, the duty of conservation and administrative inspections configure a framework that subordinates the enjoyment of ownership to the social function of housing, reinforcing the effectiveness of the constitutional right to a decent home, without fracturing the theoretical nucleus or the individual ownership of the right to property, all of which are matters of civil law.
